At the time of the police's sobriety test, Moon's blood alcohol level was 0.149 percent, which was the level of his license cancellation. According to the provisions of the DUI penalty under the Road Traffic Act, such cases can result in imprisonment of not less than one year and not more than two years, or fines of not less than 5 million won and not more than 10 million won. However, if a victim is injured in a DUI accident, the level of punishment can be raised by applying the Special Act on Handling of Traffic Accidents or the Act on Aggravated Punishment for Specific Crimes.

Many point out that the police's forced investigation is unusual when an agreement has been reached between the parties to the accident and the victim has not submitted a medical certificate. "The accident itself seems to have been minor (from the video)," said Jeong Kyung-il, a lawyer specializing in traffic accidents. "I wonder if this is an unreasonable investigation even though the victim has agreed and has not submitted a medical certificate."

Moon is accused of driving drunk in front of the Hamilton Hotel in Itaewon, Yongsan-gu, Seoul, at around 2:51 a.m. on the 5th of this month, causing a collision with a taxi while changing lanes. The police called Moon on the 18th to investigate. At the time, Moon released an apology and said, "I did a big thing that I should not do. I will live with self-reflection so that this will never happen again," and added, "I am grateful (to the victim) for accepting my apology after the accident."
