"I have to confess honestly. I have ignored the constitutional lawmakers who were elected in the general elections held only in South Korea so far. It was unfortunate and unsatisfactory that the elections that would lead to the permanent division of the two Koreas were held. Not to mention the constitution they made. I never thought it was a proper constitution. I regarded it as trivial because it was a rough-and-ready constitution made like roasting beans in a lightning bolt. It was regarded as an outdated torture. It was a copycat constitution made of other countries' constitutions, so it was shallow.
I came across a moment of the Constitution by chance. I had the opportunity to look carefully at the minutes of the National Assembly meeting at that time. I can't forget how I felt at that time. I met the vivid voices and their thoughts that the Constituent Assembly members gave me. At that moment, they were so serious and energetic! The scene of desperation and will struck my heart. The speech and logic of persuading and refuting the other person were also daunting. The moment is literally a 'political feast'. The feast made my heart race and broke my prejudice.
Let's begin the journey of time. I'd like to hear more about the story unfolding at the moment of the Constitution. Going back in time, I go to Sejong-ro 1, sit on a dark corner of the National Assembly building. Going into an unfamiliar and unfamiliar moment, I listen to the Constituent Assembly members with their eyes shining like a curious cat. I applaud some people and boo others' opinions. I admire some logic, while others' arguments are unfortunate. When the pros and cons are fierce, I support others on their side. I am also nervous waiting for the results of the vote. I would like to talk about the scenery of that moment. I want to convey what I saw and what I heard at the moment of the Constitution. I hope readers who listen to this story will experience and discover new things. I hope you can fully imagine the moment of the Constitution as if it were a legacy left without a will.
The book covers 20 days of constitutional moments. From June 23, 1948 to July 12, 1948, the day the Constitutional Fundamentals Committee reported the draft to the plenary session until the constitutional lawmakers reviewed it and passed it. At 10 a.m. on Wednesday, June 23, the draft constitution will finally be reported to the plenary session of the National Assembly. After the heated and regrettable review of the draft constitution, the last chapter of the "Constitution of the Republic of Korea" will finally be covered on July 12.
The book contains the most controversial provisions for 20 days and 14 stories related to them. The controversy over the meaning of the country's name, Daehan, whether the subject of basic rights should be the "people," the controversy over territorial provisions, the story of the March 1st Revolution being changed into the March 1st Movement, the new provisions to achieve gender equality, wisdom to extend the period of compulsory education for free, the will to liquidate pro-Japanese group, the conflict between human rights protection and strengthening of security, the meaning contained in the prohibition of diplomatic relations and the separation of religion and politics, the reason for the adoption of the "right to equalize workers' interests" which was not in any constitution, the reason for withholding the bicameral system and adopting the monolithic system, the bloody struggle over the presidential system and parliamentary cabinet system, the reason for the creation of the prime minister system, and the unfamiliar name of Shim Gye-won. I would like to tell you these stories in detail.
The framework of the story is the minutes of the time that contained the moments of the Constitution. The minutes of the Constitutional Assembly contain the vivid development of the constitutional review process. The minutes are largely divided into three parts. The first part is the first reading. Here, the members of the Constitution and the experts who participated in the drafting of the constitution hold a Q&A session on the meaning and purpose of the constitutional provisions. They also express their beliefs about the principles and contents of the constitution. The next order is the second reading. Read the provisions one by one and discuss them for and for and against. When you oppose the original draft or want to fix it, you also submit amendments. Discuss the pros and cons of the original draft and decide the provisions by voting. It is the moment when the main debate takes place. Finally, the third reading will proceed. While reading each clause one last, if there is a problem with the expression, phrase, or system, it is the order to fix it.
The meticulous stenographer captures all these and other landscapes in the minutes. Thanks to this, you can vividly meet the moment of the constitution. I can feel the atmosphere in the hall. I can even hear the sound of sitting and chanting. I captured it as if I were taking a picture. It was so clear that I could hear the sound of breathing and even my facial expression. Using that record as evidence, I drew the moment of the constitution to my heart's content.
The moment of constitution is like a shot. Fast speed leaves strong traces. First of all, there is a sense of responsibility and indelible regret that have permeated deep into debate and debate. It is full of a sense of duty that a good constitution makes a good country. You cannot easily pass any provision. How would it be if you could ponder it more deeply and think about it longer? It is impossible to do so. The reality facing the front of liberation is full of anxiety and confusion. It is a constitution, so the direction of the country must be set. Only then can a government be established. An infinite number of ideals is weighed down by the enormous weight of responsibility. A good constitution must be made, but decisions must be made under the pressure of time and conditions. Every decision made leaves a long tail of regret.
The traces of persuasion and concession are stronger. It's a waste of every second, but we do our best to persuade each other. Although we lack knowledge and experience, we try to faithfully convey our arguments. We persevere and listen. We hate the other person to the point of death, and we say harsh words, but we also apologize in the end. We are willing to make concessions and compromises at critical moments in an endless conflict. Their purpose is not a perfect constitution. We want to build a constitution that is insufficient but will guide a new country, just like a shaky compass. The signs of the shaking are recorded in the minutes.
The traces of creation are also clear. Constitutional moments are not a code that compiles different constitutions. It doesn't just copy other constitutions. Constituent lawmakers draw wisdom from a 5,000-year-old history. It also brings experiences from other countries. With the wisdom of warm-heartedness and passion for "national creativity," he is constantly proposing and discussing institutions that have never existed before and that have never existed in any country
